Scene Shop Liability Waiver

ASSUMPTION OF RISK (THEATRE SCENE SHOP – MINOR PARTICIPANT)

I understand that participation in theatre production activities, including work in a scene shop, involves inherent and unusual risks. These risks include, but are not limited to, the use of hand tools, power tools, ladders, scaffolding, rigging systems, electrical equipment, paints, chemicals, construction materials, and heavy or moving set pieces.

I acknowledge that these activities may expose me to serious hazards, including cuts, burns, falls, impact injuries, equipment malfunction, electrical shock, exposure to hazardous substances, and other risks that could result in serious injury, illness, permanent disability, or death.

I understand that these risks may arise from my own actions or inactions, the actions or inactions of others (including other students or staff), equipment failure, improper use of tools, or the condition of the facilities.

I voluntarily choose to participate in theatre production and scene shop activities and knowingly assume all risks, both known and unknown, associated with these activities. I agree to follow all safety rules, training, and instructions provided by supervisory personnel.

ACKNOWLEDGEMENT OF RULES, TRAINING, AND SUPERVISION

I understand that I am required to:

  • Complete any required safety training before using equipment
  • Follow all theatre and scene shop safety rules and procedures
  • Use all required personal protective equipment (PPE), including eye protection, hearing protection, gloves, or other safety gear as directed
  • Follow instructions from instructors, technical directors, and supervisory staff at all times

I understand that failure to follow these rules may result in loss of privileges and increases the risk of injury.

EQUIPMENT USE AND INSPECTION

I agree that I will:

  • Inspect tools and equipment before use
  • Not use any tool or equipment I believe to be unsafe, damaged, or defective
  • Immediately report unsafe conditions, damaged equipment, or hazards to a supervisor
  • Only use tools and equipment for which I have been trained and authorized

INDEMNIFICATION AND HOLD HARMLESS

I agree, on behalf of myself and my parent/guardian, to indemnify and hold harmless the Theatre Department/Scene Shop, Utah Tech University, and its Board of Trustees, officers, employees, instructors, and agents (“UT”) from any claims, damages, losses, liabilities, or expenses, including attorney’s fees, arising out of my participation in theatre production or scene shop activities, to the fullest extent permitted by law.

RELEASE OF LIABILITY AND WAIVER

In consideration for being allowed to participate in theatre production and scene shop activities, I, on behalf of myself and my parent/guardian, hereby release, waive, discharge, and covenant not to sue UT from any and all liability for injuries, damages, or losses, including those caused by negligence, arising out of or related to my participation.

This includes, but is not limited to:

  • Injuries from tool or equipment use
  • Set construction or installation activities
  • Lifting or moving materials
  • Rehearsal or performance-related technical work

GOVERNING LAW AND SEVERABILITY

I understand that this document is written to be as broad and inclusive as legally permitted by the State of Utah and agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms. I agree that this Agreement shall be governed by the laws of the State of Utah, and any disputes arising out of or in connection with this Agreement shall be under the exclusive jurisdiction of the state District Courts of the State of Utah.

UNDERSTANDING AND ACKNOWLEDGEMENT

  • I understand the risks involved in theatre and scene shop activities
  • I am voluntarily participating
  • I understand that I am giving up substantial legal rights

If I am under 18 years of age, this agreement must also be signed by my parent or legal guardian.

I am the parent or legal guardian of the participant. I have read and understand this agreement and consent to my child’s participation in theatre production and scene shop activities.

I acknowledge and agree that:

  • I assume all risks on behalf of my child
  • I release and waive liability as described above
  • I am responsible for my child’s compliance with all rules and procedures
